POLICY ON MAINTENANCE

OF CLASS 4 HIGHWAYS

 

 

Attached is a copy of Chapter 003 of VSA Title 19 which applies to the classification of Town Highways. Class 4 highways are defined as any highway not classed as Class 1, 2, or 3.

 

Section 310 of VSA Title 19, Chapter 003 states "Class 4 Highways may be maintained to the extent required by the necessity of the Town, the public good and the convenience of the inhabitants of the Town...

 

Certain court decisions have held that the Town must provide equal treatment in the maintenance of roads in  that roads of similar nature must be maintained equally.

 

In most cases there are very few dwellings built on Class 4 Highways, therefore, either no maintenace, or very minimal maintenance is the policy of Towns. Because of the amount of dwellings ( 12-14 ) with even  more development in the near future, as well as  maintenance of new water tower, we find it necessary to amend original Class 4 (Lovers Lane) Policy.

 

Town Highway 10 (Lovers Lane) is a road of approximately 1.04 miles in length with a steep grade of as much as 12% and a width of 3 rods ROW. We hereby amend the policy as follows: The Town will scrape Class 4 Highway (Lovers Lane) no more than three times per year, applying calcium chloride once per summer, and will perform minimal plowing / sanding after all other Town Highways have been plowed but no later than 24 hrs. after each  snow storm. Plowing will occur only after a 3+ inch snow storm. No overtime hours shall be incurred by Road Crew without prior approval of Road Commissioner or Selectboard.

 

Maintenance of Town Highway 10 (Lovers Lane) by Adjoining Landowners

 

The Town recognizes that landowners adjoining Town Highway 10 (lovers Lane) customarily perform snowplowing and other maintenance tasks. The Town is concerned that if such activities result in injury or damage to the public, the Town bears a portion of the liability. The following procedure is intended to protect the Town.

 

(1) All persons who desire to perform maintenance projects on the Highway will notify the Selectboard at least 21 calendar days prior to the commencement of activities.

 

(2) The Selectboard will notify by regular mail within 5 calendar days, all property owners                   adjoining Town Highway 10 of the intended activity. Property owners will have 15 calendar days to register comments with the Selectboard.

 

(3) The Selectboard will notify the applicant of their approval / disapproval of the request.

 

(4) Approval for regular minor activities such as pot hole filling, snowplowing, etc., will be granted on a continuing basis, subject to revocation for cause.

 

(5) The Road Foreman will inspect work being done to ensure adequacy and quality. If the work fails to meet inspection, and the applicant refuses to correct the problem, the Town will correct the problem and bill the applicant for the cost of the work

 

 

WINTER SAND / SALT POLICY

 

 

 

The Selectboard of The Town Of Grand Isle hereby establish this Policy to regulate the use of Sand/Salt by Town Residents / Taxpayers

 

We will continue to allow Grand Isle residents to pick up sand / salt mixture for their own use for driveway's, steps, stairs, etc. usage must be minimal and own tools will be used for loading. These residents may not sell this sand / salt for profit.

 

We do not advocate selling Sand / Salt to commercial businesses, they need to make an effort to stockpile their own winter materials. However, local businesses may be allowed to purchase materials in the event of an emergency, providing materials are available. The price will be established by the Road Foreman and the Road Commissioner by Nov. 1st. Service will be discontinued for non-payment or abuse of Town Property.

 

A Commercial Business / Operator is defined as follows: Any operator of a salt / sander unit who spreads Sand / Salt materials for re-sale to customers.

 

This policy is for Grand Isle Town Residents / Taxpayers only, Non-Residents shall seek materials from the Town they reside in.
